
Based on a focused study of global patent systems and their economic impacts, Dr. Gulzar Singh, an independent Indian inventor and researcher, presents this analysis for the purpose of informing the public and the Government of India. The study reveals that India is facing a serious and persistent loss of intellectual property, primarily because economically disadvantaged inventors are unable to enter the national phase under the Patent Cooperation Treaty (PCT).This failure is not due to a lack of innovation or technical quality, but rather to a lack of funding. Consequently, many Indian inventions are used worldwide without any payment or benefit. The study explains that India files thousands of PCT applications each year, but many of these applications never reach the national phase in any country.After mandatory international publication, such inventions become open to the world. Financially strong foreign companies can then legally use, manufacture, and sell these inventions, without paying royalties and without disclosing the name of the Indian inventor. This disadvantage is primarily due to the high costs of the national phase.At this stage, inventors must pay for translations, fees for foreign patent agents, examination fees, and government fees, especially in markets like the US and Europe. Most individual inventors, MSMEs, rural innovators, women inventors, and first-generation entrepreneurs cannot afford these costs, even if international research reports confirm that their inventions are useful and technically sound.This illustrates how globally, ownership of innovation is often determined not by creative ability but by economic power. The study also links this problem to the large number of patents in India that lapse due to non-payment of fees, commonly referred to as dormant or “zombie patents.” These lapses represent a real loss, as they waste research effort, time, and money.When such losses are compounded across sectors such as pharmaceuticals, clean energy, electronics, software, industrial design, and manufacturing, they reduce licensing income, weaken exports, erode technological leadership, and reduce employment opportunities. International research also shows that countries with inclusive protection of intellectual property experience faster economic growth, while countries that do not protect vulnerable inventors see value gradually drain away.In the context of India, this study warns that the continued loss of ownership of Indian knowledge could undermine long-term economic growth, not because India lacks talent or ideas, but because India repeatedly loses control of the economic benefits that flow from those ideas.The study clearly warns that the loss of approximately ?2–3 lakh crore every year due to patent abandonment due to economic compulsion is not just theoretical but real and ongoing, and if ignored, India's growth potential will gradually weaken despite any innovation slogans or big patent figures.The study also suggests that this situation can be improved. If individual inventors and MSMEs are supported to retain their patent rights, many inventions that are lost today can become protected assets and generate economic value through licensing, partnerships, and domestic manufacturing.The study also shows that the current system harms rural and women inventors the most and discourages future innovation, as inventors who lose their rights due to economic reasons rarely try to re-patent.In this context, Dr. Gulzar Singh presents the concept of “Design-in-India” as a future foundational model to strengthen Make-in-India, and points out that self-reliance through manufacturing alone cannot be sustainable unless the original design, invention and ownership are protected at the outset.Without such protection, Indian creativity becomes a free input for global competitors. Ultimately, the study concludes that failure to secure national funding for economic reasons silently extracts a significant amount of intellectual property value from India every year, undermining fair innovation and global competitiveness, and if this gap is addressed, many more “lost Einsteins” from disadvantaged communities could emerge, giving a real boost to India's potential to become a $10-trillion economy by 2035, and patronage of inventors becomes a national economic strategy, not just an aspiration.
